What is the Tennessee Lemon Law?

The Tennessee Lemon Law is designed to protect consumers who purchase or lease new vehicles that turn out to be defective. The law specifically covers vehicles that experience a non-conformity—a defect or condition that substantially impairs the vehicle’s use, value, or safety. To be eligible for protection under the Tennessee Lemon Law, the following conditions must be met:

  1. Attempts to Repair: The defect must not be fixed after a reasonable number of repair attempts (typically three) by an authorized dealership.
  2. Timing: The non-conformity must occur within the first year of ownership or during the term of the manufacturer’s express warranty, whichever comes first.
  3. Time Out of Service: The vehicle must be out of service for repairs for a cumulative total of thirty (30) or more calendar days during the first year or the express warranty period, whichever comes first.

What Vehicles are Covered Under the Tennessee Lemon Law?

The Tennessee Lemon Law covers new vehicles that are used primarily for personal, family, or household purposes. This includes vehicles that are purchased or leased within the state of Tennessee. However, the law does not cover certain types of vehicles, such as:

  • Trucks with a gross vehicle weight rating over 10,000 pounds
  • Motorcycles
  • Motorhomes and recreational vehicles
  • Off-road vehicles

Federal Breach of Warranty Protection

If your vehicle falls outside the limitations of Tennessee’s Lemon Law, you may still be protected by federal laws, such as the Magnuson-Moss Warranty Act. This federal statute provides additional protections for consumers who have purchased vehicles with ongoing defects that are covered by either an original or extended manufacturer’s warranty. If a problem persists despite multiple repair attempts, you may be eligible for compensation or other remedies under federal law.
