If you have purchased or leased and registered your new car in Pennsylvania, or you purchased or leased your vehicle in another state but registered for the first time in Pennsylvania, you could qualify for protection under PA Lemon Law.
The law applies to vehicles that have been back to the dealer for a continuous number of repair attempts for a defect that impairs use, value, or safety (typically three or more), with the first occurrence in the first 12 months or 12,000 miles, whichever comes first. It also applies to vehicles that have been out of service thirty or more days within the first 12 months or 12,000 miles, whichever comes first. Those days do not have to be consecutive or even address the same issue.
Under the Pittsburgh, PA Lemon Law, depending upon the severity of the issue and number of repair attempts or days out of service, you could be entitled to:
A COMPLETE REPURCHASE INCLUDING TAXES, TAGS, DOWN PAYMENT, FINANCE CHARGES, TRADE IN…EVERYTHING YOU SPENT ON THE CAR, MINUS A SMALL MILEAGE OFFSET TO REFLECT THE MILEAGE WHEN YOU FIRST BROUGHT THE CAR IN FOR SERVICE. YOU GIVE BACK THE VEHICLE, AND YOU ARE DONE.
AN MSRP TO MSRP SWAP (NOT APPLICABLE WITH LEASES). If you were to trade in your car, it would suffer significant financial depreciation. This is a trade without depreciation. You receive a credit for the MSRP on your car and it may be used toward the MSRP of a brand new car, so ideally it will be a pretty even swap. You can also apply it toward the MSRP of another model offered by the manufacturer. And you will have the same equity in the new car as you had in the old car.
IF WE CANNOT SECURE A REPURCHASE OR A NEW CAR, OR IF THE PROBLEM IS FIXED, WE STILL FEEL YOU ARE ENTITLED TO SIGNIFICANT MONETARY COMPENSATION, PLUS YOU GET TO KEEP YOUR CAR. Your car is NOT branded in any way, shape or form, your warranty remains fully in effect and you do not need to disclose that you received this money at time of trade or sale.
Purchased a used car with a manufacturer’s warranty, or you fall outside Pennsylvania Lemon Law parameters?

When you purchased your vehicle, you paid for a manufacturer’s warranty that was to ensure that problems were fixed efficiently and effectively and they were not. You may do whatever you want with this money, And again you maintain full ownership of the vehicle, your vehicle is NOT branded in any way, shape or form, your warranty remains fully in effect and you do not need to disclose that you received this money at time of trade or sale.
