Western New York Lemon Law Protection: What You May Be Entitled To

If you purchased, leased, or registered a new vehicle in New York, you may be covered under the New York Lemon Law. Here’s how it works:

  • The law covers new vehicles, motorcycles, and motorhomes, including certain leased vehicles.
  • Coverage extends for the first 18 months or 24,000 miles, whichever comes first.
  • To qualify, the vehicle must have:
    • Undergone four or more repair attempts for the same substantial defect within the first 18 months or 24,000 miles, or
    • Been out of service for a cumulative 30 days for repairs related to any defect during the same period.
  • The defect must substantially impair the vehicle’s value, use, or safety.
  • Issues can range from check engine lights, water leaks, vibration or “death wobble”, locking issues, infotainment system issues, transmission troubles, or any other matter that impacts the vehicle’s usage.

If Your Vehicle Qualifies for the New York Lemon Law, You May Be Entitled To:

A Complete Repurchase
You return the vehicle and receive a refund of the full purchase price, minus a deduction for mileage exceeding 12,000 miles. We will also guide you through the process of obtaining a refund of applicable state sales taxes. If it is a leased vehicle, you will receive a significant percentage of your lease payments back.

A Replacement Vehicle
If approved, you can apply the manufacturer’s suggested retail price (MSRP) of your current vehicle toward the MSRP of a new vehicle from the same manufacturer, without suffering the depreciation that comes with a trade-in.

Cash Compensation While Keeping Your Vehicle
If the defect has been repaired or a repurchase isn’t possible, you may still be entitled to monetary compensation for the diminished value of your vehicle. Your title is not branded, your warranty remains valid, and you are not required to disclose the settlement at the time of sale or trade-in.

Purchased a used car with a manufacturer’s warranty, or you fall outside NY Lemon Law parameters?

When you purchased your vehicle, you paid for a manufacturer’s warranty that was to ensure that problems were fixed efficiently and effectively and they were not.  So, we aim to secure you compensation to reflect the diminished value of your vehicle as a result of the problem.  You may do whatever you want with this money, and again you maintain full ownership of the vehicle, your vehicle is NOT branded in any way, shape or form, your warranty remains fully in effect and you do not need to disclose that you received this money at time of trade or sale.
