My Car Has Been In The Shop For A Month. Do I Have A Lemon?
We are getting more and more calls on the 1-800 LEMON LAW hotline from distressed drivers who are waiting for parts that are on back order. They can’t understand why it takes so long to get their car fixed, and they are fed up with driving a loaner car for a month or more while they are awaiting the arrival of their part, normally from abroad.
So, why is this occurring and is there anything we can do about it under State Lemon Laws and/or the Federal Magnsuon Moss Warranty Act?
As we have previously reported, when the companies were trying to cut costs in the troubling economy, they closed down many of their factories. The end result is that in many cases, they do not have the materials and manpower to ensure that parts are available in a quick and timely manner. It’s the nature of the beast and no matter how hard they try to fix this situation, there is very little they can do. If you have a problem that is not occurring in many vehicles, they are not prepared because they are not laying out funds to have parts just sit around. If it is regarding a problem that is occurring in a number of cars, they simply cannot fulfill the demand.
So, if your part is on back order and you find yourself without your car for a long period of time, what can be done?
The good news is most State Lemon Laws define a lemon as a car that is in the shop for an extended amount of time within a set period. The Pennsylvania Lemon Law, for instance, defines a lemon as a car that is in the shop 30 or more days within the first 12 months or 12,000 miles. The New Jersey Lemon Law defines a lemon as a car in the shop 20 or more days within the first 24 months or 24,000 miles.
The New York Lemon Law covers drivers whose vehicles suffer a nonconformity or defect within the first 24 months or 18,000 miles, whichever comes first, that can’t be repaired after repeated attempts (normally 3-4) by the manufacturers authorized dealership.
To check out your state’s statute, click here. In most cases, these days do NOT have to be consecutive, nor do they have to be for the same issue. Make sure sure that when your car is finally ready that you receive a repair invoice which clearly outlines the amount of time that car was in the shop.
Then contact us or another consumer attorney to look into your rights under the Lemon Law. Under the Law, you may be entitled to a new car or complete repurchase.
Even if the car is fixed you could be looking a significant monetary compensation to reflect the diminished value of the car (plus you would get to keep the vehicle.) It’s really important that you know your rights and you fight for what is yours, especially since the the legal representation is free.
So what if you fall outside of the Lemon Law parameters, but your car is still sitting in the shop wasting a month or two away.

Bought a car in MA from Credit Rebuilding company. Because of age of car, warranty was only for 30 days. Car was brought to shop about 3 weeks from date of purchase for bad heater, two leaks and some other electrical issues. I think the inspection was forged as well, because the guy who owns the dealership owns the inspection station as well.
I saw the car being driven around and immediately questioned the driver. Who had no answers to my questions, other than that he was the mechanic for the dealer. The car had my plates on it, not repair or dealer plates.
A few days after taking the car from the mechanic, the heater core went, so it was brought back to the same dealer, because I can’t afford to bring it anywhere else. It has been there for one month. Every time I call, I keep getting the run around. For what I paid for this car, there should not be any problems with it.
What do you guys think?

I believe I contacted you previously. The dealer I purchased the truck from still has my car since 6/4/12. Can you tell me if I am able to file a law suit in Special Civil under the lemon law? I feel helpless. I filed a complaint with the NJ DCA and I spoke to the General Manager and nothing. Any information you can give me will be tremendously appreciated. I believe I should not be paying per month for a truck I am not able to use.

I bought a 2006 vehicle with 48k miles on it, back on Monday, Sept, 10th. I found out within the first 12hrs that the ignition switch was faulty. Therefore ,the car would not lock (without using the key to manually lock all four doors)…and the trunk/hatch could not be locked at all (since there is no key hole). I was given a loaner by the dealership on 9/12, and they have had my car ever since (3 weeks now)! I spoke with the GM (after speaking with several sales managers), who told me that the part is now on backorder. NJ Lemon laws say nothing about electrical…only mechanical (ie: engine, transmission). Sure they gave me a loaner vehicle free of charge…but this is extremely frustrating. Why should I make a car payment and pay higher insurance for a vehicle that is STILL not is my posession? Pls advise. Thank you.

Mark: The NJ Lemon law does cover electrical issues, but you would not fall under that stature. You are referring to the used car lemon law and for that you will need to reach out to the Attorney General.

I have a quick question. If my car is going to be in the shop for more than a month (almost two) and I won’t have my car for the whole month of June. (They said the part won’t be in till July 9th) what rights do I have in regards to having to pay for a month that I won’t have my car? Is there any law that requires the company to pay for the month that I won’t have my car? It’s really frustrating. I love my car and honestly I’d rather pay my car payment then have to drive the dealers complimentary vehicle. But I do find it unfair that ill have to pay my bill and not drive my car.

We bought a used 2011 Hyundai Tucson with less than 19,000 in February of 2012. It’s been in the shop for exactly one month as of tomorrow and we’ve had to pay for a rental this whole time (the taxes anyway, which is less than $4 a day.) is there anything we can do? We’re in Arizona.

I purchased a 2012 BMW 650i in April. I got into a car accident on June 19th. The car has been in the body shop since June 21st. BMW is saying that the parts to repair the car are on back-order with no expected date of arrival. So far I’ve been waiting three months. I didn’t take the car to BMW directly, I took it to a reputable body shop. The car is still under warranty and I have an extended warranty as well. No loaner vehicle was provided by BMW…

Hello, I reside in Pennsylvania. I purchased my new car a few months ago, and the dealership damaged the paint all over the vehicle. They had the vehicle for about 2 weeks fixing the issue. They said it was fixed, but they just used a filler. Fast forward to a month ago and the dealerships Bodyshop damaged my gauge cluster plastic (large scratch). I took the vehicle in to get that replaced, and a tire mounted. They gouged my wheel. It has now been 30 days since the dealership has had it. Is this considered part of lemon law since the dealership damaged the vehicle, and has had it for 30 days?

My Hyundai Touson has been in the shop since December 12, 2015. Hyundai has supplied me with a loaner car that I do not haft to pay for so far. I went to the shop this week to check up on my car and my drive train is still on back order for another month to 2 months. I still owe on my car, what can I do? If they cannot fix the problem would they reimburse me or offer me a deal in another vehicle?

I bought my car used in NY in March 2015, but am the second owner, so the warranty is still in place. Fast forward to Sept 9, 2015, my car starts making a loud knocking noise, find out that Hyundai put out a national recall on 2011-2012 Sonata’s due to a bearing issue. My car dies and has to be towed to the dealer, and they say the engine has to be replaced, which is under warranty, but falls in the guidelines of the recall. It is now Jan 18, 2016, and Hyundai still says the part is on back order and there is no ETA! What options do I have?

I bought a car and 2 weeks later a wheel just broke, it was a brand new altima, the dealer sent it to a shop about 4 months ago, the car has been there and they keep telling that will be ready for next Monday since Christmas, I have been paying for a car I am not driving and my insurance did not covered a rent car, the shop is not taking my calls or they tell me to check with the guy in charge who keeps telling me “it will be ready for tomorrow” I need my car I am in Texas, is there anything I can do about?

Bought a new 2016 Ford Explorer January 2016. June 21, 2016 11,000 miles later the car broke down. I was told I need a new throttle body. They are on back order – not sure when they will get a replacement. If this is not replaced within 30 days, does this qualify as a lemon under New York State lemon law?

Hello-
I bought a brand new 2016 428i BMW Grand Coupe directly from the BMW dealership. My car was hit on the driver side door while parked and my insurance company did an estimate for the repair.
I found a body shop to do the repairs; dropped off my car on June 27, 2016.
On July 8, 2016, the body shop called me back to pick-up my car, as the repair to the door was completed. When I picked up my car I notice that the repair shop had scratched the door handle inside, so they had to order a new part from BMW.
On July 13, 2016, the body shop called me to tell me the door handle has not arrived yet, but I can pick-up my car and they will call me when the part arrives. When I arrived at the repair shop, I notice that my hood was scratched. They kept my BMW to fix the scratch.
On July 15, 2016, the body shop called me saying the hood has been repaired as well as the door handle. When I got there, they forgot to fix the 2ns piece of the door handle (there’s 2 pieces), AND I found a scratch on my bumper. They said it will take 3-days to fix the bumper, and they will also fix the 2nd part to my car handle.
The body shop has had my BMW since June 27, 2016
They fixed the door that was caused when someone hit my parked car
BUT 3 other things have appeared on their watch, which they are still working on to fix.
Do I have a Lemon?

Hi there- thx for the reply to my question above!
What about the other 3 repairs that the body shop had to do that was not due to an accident, but rather happened in the watch of the repair shop.
1. scratch on door handle
2. scratch on hood
3. scratch on bumper
Does it fall under Lemon Law that the body shop has had my car since June 27 and each time I go to take a look at my car, there’s a new scratch on my car that was caused by someone at the body shop, which makes me wonder what else they might have done to my car (but I just haven’t discovered yet).
My car has roughly 5,200 miles on it and I’m concerned that the body shop might have done more damage to my car, since each time I look at the car – I discover a new scratch.
Hope my question makes sense.

@Natalie: Hard question to answer. I don’t think we could hold the manufacturer responsible for the scratches, but I would certainly bring them to your insurance company’s attention.

So I have a 2015 mustang gt the clutch went out at 30,000 miles dropped it off at the dealership and after 3 days told me they were going to replace it parts were ordered they gave me a rental for 5 days only, parts took longer and warranty said they will pay for 10 days total and no more so those 10 days went by and parts were still not in, had to give back the rental since they woudnt pay no more, so 4 days later with no car, parts come in 2 days later after parts come in they tell me the clutch is finally installed but that the transmission went bad third gear would grind and that they will have to submit the report to warranty and see what they want to do its been 2 weeks now and they haven’t even touched my car again to let me know what’s gonna happen so I have been car less for about 3 weeks now because warranty does not want to give me a rental is there anything I can do?

@Alex: Once the car is fixed, you may be able to appeal to corporate to seek reimbursement, but be weary. That reimbursement may require a release which could void rights under Federal law if problems come back.

my car has been in the shop for about 20 days and they said i won’t have it back before the 26th of august. i am in Texas and i have a loaner that sucks and was trying to sell my car too or trade it in. the problem is an AC actuator that is on back order and have no real ETA for it they just keep pushing the date. do i have a a case for a lemon? car was bought new still under warranty

My vehicle’s engine light came on after 20,000 was told by the dealership to wait to have service since they were backed up and it would take over a week to fix it. After 40,000 insisted they fix it. Whatever they did only made it worst and the vehicle could not be driven. It has no been six weeks and the manufacturer can not seem to advise the dealership how to fix it and are claiming they have never had this problem before. I know in Texas the Lemon Law covers the first year or 20,000 but are there any exceptions?

I dropped my car off on October 18th, 2016 for an apt with Dodge for a strange sound. They found out it was dealing with the transmission, and specifically a torque converter. They said it was covered under PowerTrain. It is coming close to a month since I have seen the car due to the Torque Converter being on Back order from dodge. They could not give me an ETA at all, so this car could easily be in the service for several months while I’m still paying monthly payments. Is my car considered a lemon? I bought the car used and I’ve only owned it for a month and a half, and the car being out of service for 30 days rule is incoming. Today is November 11th, 2016. In Virginia.

I live in ny and I brought my car in bought used with extended warranty they said it does need a part and said the ordered it. A week later I gave a call and they told me the part is not available anywhere but may become available. in the mean time I do have a loaner. Are there any laws on how long they’re allowed to wait for a part if you come available or am I supposed to just pay for a car that I don’t even have in my possession it’s been over a month already.

So I realize I was a little vague at my last post. I bought my car it is a 2012 Subaru Impreza when I bought it it had 48,000 miles on it now has around 65,000 I brought the car in and it actually needs a seat frame which the dealer told me it’s covered under the extended warranty. I bought the car certified used with the extended warranty. I brought the car in and so far it’s been about three weeks. they still have no idea when the part will be in I’m currently in a loaner because it’s driveing my car would cause further damage to the seats. I know I’m technically outside the lemon law but is there another law on how long they can have me waiting for a part ? Or can they keep me waiting months and months for a part that may never come

Hi I bought a 2016 I’ve in mt my car makes this awful whining noise from the power steering pump when I went in for my first oil change I asked about this noise and that told me this was normal (about mid November) then in December I noticed mt mode door actuator was making a noise I stop by the dealership and they couldn’t get it to make the noise. Then in January when I took it in for the second oil change I asked about the whine again and the actuator the services manger stated that maybe snow got in their and he would check it out none of these complaints where put in my records then February 8 my husband was in the car and the whining noise was loud you could here it over the radio and the heater so he called the dealership and they said it was normal we should call corporate office so he did they opened a case and said nope it’s normal. It not normal the make of car I have had tons of post of the noise when the drive a brand new car theirs no noise and their are ppl that worked for Nissan that say the noise isn’t normal and Nissan said it’s a manufacturer defect but the findnit more economical to ignore the problem. So I called bbb and opened a case just before I called February 28 I got my mode door to make the noise I needed and when to the deal and had the tech look at it and he said order the heater box (i.e. They need to take my whole dash out to replace this box) two day later I made the call to bbb and opened the case the next day I got a call from Nissan corp and they said they won’t buy the car back and they will send a tech out in the mean I was at the dealer once a again for the whine noise they tried rubber washers to make it quieter didn’t work they order a power steering pump pump but that’s sitting at the dealer for a week no because they are wait for the tech to come and they said they can’t touch my or listen it to because we stop in their this past Wednesday because the whine was so bad and that’s what they said along with a new problem that has pop up my tach jumps all over the place my concern is that the dealer hasn’t keep my car nor have they even tried to fix any complaints that I had until I call bbb what so I do

My 2016 BMW X1 was taken to the body shop on March 3rd. May 4th the work is not complete due to engine issues and parts. The mechanics are unable to get the vehicle to run properly. This was the result of an accident. 60 days out of service and no end in sight. Is there any consideration for this falling under the Lemon category? Thanks!

I recently bought my car FIAT back into the dealership to fix and it is a transmission problem that is under cover by warranty. It been about a month already all they are telling me is they still waiting for FIAT to get back to them and see if they will approve them to rebuild or replace a transmission. Now I m wondering if I can use Lemon Law in this suitation.

I purchased a brand new 2016 Subaru Legacy. The same year a recall came out for steering wheel failure. That was fixed but it took them about 2 weeks since the part was on back order. Back in May I started having issues with the key getting ignition switch. I made an appointment and brought it in on June 6. They later contacted me and advised that there was no problem and I had to pick up the car. I picked it up and as soon as I got home the same issue occurred, so I took the car back to the dealer a few days later and again they called me a week later to tell me they could not find any issues. I spoke to the service manager and explained to him the issue and told him I was not picking up the car until they fixed the issue. They called the following week and still said they were unable to replicate the issue. I went to pick up the car to take it to a different dealer and the manager came out. Luckily this time he was there when the key got stuck, so they took the car in again and til today I have not been able to get my car back. The part is still on back order. The first time took my car in was on June 6 and today is July 11 and my car is still not fixed and the part has not yet arrived to the dealer. What can be done in this case?

I recently bought a 2016 Chevy Malibu on July 8, used with 27000 miles, on the way home, a block away from my house, which was 2 miles away from the dealership, the check engine light came on, check stabilitrak and the car lost power. It was brought to the dealership back on July 9 but since it was a Sunday, it didn’t get to the service department till the next day. Now it’s July 14, and they are not telling me anything. Is there anything I can do other than wait?

Purchased my 2017 Colorado in April ’17. Dropped it off at the dealership on 16 Aug 17. Will hit 30 days on 15 Sep 17 at the service center for transmission and A/C problems. Waiting on new transmission after previously failed fix. Called GM to expedite the process and they closed case because they hadn’t had the opportunity to fix it yet with transmission on backorder. Do I have a case once it hits 30 days? ARS 44-1263 outlines lemon law for new vehicles in repair for 30 days or more. Thanks.

I live in Alabama. We have a 2015 Dodge Journey. Less than 30k miles on it still under warranty. The abs sensor went out. Went to dealership they told us the parts are back ordered and don’t know when they’ll be available. They won’t give us a loaner vehicle for safety reasons they just told us don’t drive where you’ll have to slam on your breaks. What can I do? This is not safe for my wife to drive.

My car’s fan burned out and it started to over heat. There was a lot of smoke & it look like it was about to catch on fire. I have a 2016 Jeep Renegade bought it new in July 2016. I have had it just a little over a year. Took it to the dealer on 10/2/17 and it’s still sitting there. Two weeks ago they told me it was on first priority and would be ready beginning of this month (November). Today 11/6/17 my husband called them to follow up the service guy is now telling us that they don’t have a date to give us of when it could be ready. They haven’t ordered the part yet because they say it’s on back order and the manufacture doesn’t have the part to fix the problem. They did give us a loaner for the time begin. The dealer keeps advising us to trade the car in because it could be a while and they have two other Jeeps in with the same issue. When we tried that route it was just not worth it due to the dealer offering us way less then what we still owe. Financially we just can’t because we would have to pay double per month for the new car than what we are paying a month for the Jeep. I hear that we have to give the dealer a chance to fix the car before we can apply the Lemon Law. Is this true? If so, do I have other options?

My 2018 bmw 550 has been in an accident on dec 1 st and 98 percent of parts have been replaced except for 2 that have been on back order by manufacturer with no end in sight and they r telling me might take another month or so . Hi. We bought a 2016 GMC Terrain from Enterprise with 25,000 miles on it in 2016. We also bought and extended warranty. I brought it into the dealer once due to some tranny pulling, and they found nothing. I was having intermittent dimming of the dashboard and mentioned this to them but they did not note it. The tranny pulling has been a consistent issue but they couldn’t recreate it so they blew me off. Fast forward to this last week. The Stabilitrack came on, and the transmission would barely work. Called the dealer on a Saturday when we were out and it happened and he told me to restart the truck since it was probably a computer issue, and I made an appointment to bring it in Monday. I did it and it seemed to drive fine for a while. I drove it again around the corner Saturday and when I pulled into our driveway and put it in park it clunked and would not move. I rented a car on Sunday to get to work. My husband called the GM service line and they came to pick it up on Monday, and the car wouldn’t even start. Went and got a loaner from them, and they said they cleared the computer since there were too many codes, and it started, but the car would barely move. They stated they thought it was an electrical issue, and it would be $89/hr to diagnose, and they were pretty sure that the warranty would cover it. I now have 55,300 miles on it–so the tranny what we thought it was–would be covered under the powertrain warranty. The issue is now it is Friday–they have had the car since Monday–and they STILL cannot find what is wrong with it. I know we are out of Lemon Law in Arizona. I have a feeling that this is going to not get fixed–what should I do if they cannot fix it?

I purchased a certified pre-owned 2015 Audi with 23k miles on it on 12/2/17. On 2/3/18 it started leaking coolant. It is now 3/24/18 and the dealership still has my car with no indication of when the part will arrive. I was told by the manager there is nothing I can do other than wait. Because it’s a used car, is this true?

I’ve been having issues with my 2014 Chevy Spark for months. The transmission started slipping so I took it to a local Chevy dealership. After taking it in and leaving it with them twice, they were never able to pinpoint the problem and just gave the car back to me with a slipping transmission. I then took it to a Chevy dealership out of town who immediately diagnosed the problem.
They have gone through the process of getting a new transmission approved under GM warranty, but it’s been almost two weeks already and they just tell me it’s on backorder.
As I’ve said, it’s only been at the dealership it’s currently at since 5/14, but I’ve been trying to have this issue dealt with since the beginning of March.
Any suggestions? I want this over and done with. I have a car I put a deposit on to trade mine in for, but I can’t do that because I’m still waiting for it to get fixed. Incredibly frustrating, and I don’t want to lose out on the car that I really want because this is taking so long but I can’t afford not to trade the Spark in.

I bought my Kia Forte 2014 in August of 2016, now May 2018. When I purchased it, it is important to note that it took them 5 months to get me the proper registration, and it took me telling them I was about to default on my car loan due to missing documents before I got the proper forms. I noticed a weird sound in the engine last July (2017) and had it inspected. I have the paperwork which states the sound is normal and there are no issues. The car broke down on December 2017 and I complained again about the engine noise. When it was towed in, I got a new battery and new front breaks which cost close to $500. In January 2018 the engine started stalling and I took the car in. They attempted to give it back to me claiming nothing was wrong. (It was 600 miles from the end of it warranty). They offered to keep it one more night and see if it stalled on them in the morning. When it did, they called and told me my engine has thrown a rod (the knocking sound I heard) a Cylinder was dead (why the engine was running well) and that the car needed an entire new engine. They said there was one in the states and I’d have my car back in 2 weeks tops. They gave me a rental car – no cost, and in June it will be four months that they’ve had my car. I’ve spoken with headquarters, customer affairs, and they told me the engine is on back-order from Korea, and there isn’t anything that can be done. That they have no ETA and today the woman I spoke to at Customer Affairs assured me I would be “compensated as this was their fault not mine.” I went to the dealership and got in writing that I wouldn’t be responsible for any rental car fees or maintenance, nor would the warranty time out while waiting this back-order out leaving me with the bill. What are my options/what can I do here. I believe they sold me a lemon, but its been past 12 months, and Colorado lemon law is 1 year. What can/should I do.

My Hyundai Elantra 2012 was making some noise while driving and a dealer here told me that the rod bearing next to engine was going bad. He told me that both engine and rod bearing along with certain other parts would need to be replaced. They kept my car with them in mid-Feb and verbally told me it will take them a month to fix. It’s mid-June right now and they keep telling me it will be ready next month as Hyundai had put engine and other parts in backorder and until they send the engine and parts to these people, they cannot do anything. Is there a way to deal with this? I called them today and they again said that might receive parts this month and my car could be ready by next month.

I own a 2016 Nissan Frontier with 30,000 miles. I was involved in an auto accident where I was rear ended and shoved into the car in front of me. I took the truck to a reputable repair shop recommend ny Allstate. I have returned the truck 4 times for the same problem, they sent me out for a test drive that their mechanic who stated it is something wrong with the suspension on the right front and he can hear metal rubbing metal. The truck doesn’t drive the same, the front end skips over bumps and there is a popping feel in the steering wheel. I feel unsafe driving it. Do I have any rights? As I said it has been back 4 times ant they have had it a week each time.

I have 2016 Chrysler 200 I started having problems where it wouldn’t start or had no power to go in Nov then with regular oil changes oil light came on & it wasn’t time for oil change. Then on Jun 6th right at 30,000 miles engine light came on and it’s at dealership for catalytic converter to be replaced. I know it’s been in shop more than 30 days this year, but they acted like I was crazy and nothing was wrong with vehicle. My 3 yr warranty is fixing to expire and I’m worried.

In March 2018, I bought a used Range Rover 2017 with 6K miles. Two months later (May 2018) and barely traveled 600 miles, there were 3 electrical and / or electronic damages. Two of those 3 defects (say Land Rover Dealer) were corrected (I do not know). The third damage is related to a part that they have not been able to obtain in two months (says the manager) anywhere in the world, not even in the Land Rover factory in England. Today, and with the inconvenience of the case, I spoke again with the manager who felt obliged to confess that the factory that manufactures the part does not exist, the factory is bankrupt or is not producing that part … I asked him to remove the piece of one of their new cars 2018 and he said that they were not electronically compatible due to the incompatibility of my VIN number … In short, nobody knows for sure what is happening with the part or who makes it and the reason for the which does not dispatch it. The fact is that I have been without my car for two months and, although they gave me a loaner, my great dissatisfaction results from the fact that I bought an almost new car and paid for it in cash and I have not been able to enjoy it. According to what I understand of the Lemon Law (if applicable to my case) 1). The dealer would be obliged to reimburse me the money I paid, or 2). Give me a similar car, or 3). Deliver me a new car as compensation for damage that even remotely they know when they can correct
The car has a factory warranty bumper to bumper until 2022
The truth, and without the slightest encouragement to pretend to take advantage of the circumstances the only thing that would give me satisfaction after 2 months of waiting and sterile discussions with Land Rover the solution “acceptable” and appropriate for me, would be that they gave me a Range Rover zero miles Is this possible according to Federal laws or Lemon Law ????
I do not want my money back because I will not be able to get an equally impeccable car with low mileage in the car market.
I also do not want a similar car used because I have already examined the used car market and none is 6K miles away or as impeccable as mine.

My 2015 Kia Soul had an engine failure early this year. Completely seized up. Had it towed to the dealership. Had to have small block engine replaced. Thank goodness it was covered under warranty (plus $200 in related maintenance NOT covered)… less than 2 months later it happened again. Towed it into the shop again at the end of May, now the needed part has been on back order, and it’s now the end of AUGUST. Dealership dragged their feet on providing me a rental for a week. Furthermore the dealership failed to schedule my rental when they said they did, so when I arrived at enterprise they were unprepared and forced to give me the last and least liked vehicle on the lot. Which I have been stuck in Now for 3 months.
I was told my engine would be available the 3rd or 4th week of July, then August 14, then August 28th, and this morning I just got a call saying MID SEPTEMBER.
Starting to think I’ll never see this car again……

I bought a car for my daughter two months ago at a local car dealership. It was a second hand car. They gave me a extended bumper to bumper warranty, new brakes, etc, the usual stuff to get you feeling like they are treating you right. Anyway, my daughter drove the car for a couple of days then saw the oil warning light come on. It said to add a quart of oil. So I bring it back to the dealership and told them the problem. They decide to fill it up with oil and send us on our way. Another couple days go by, same thing my daughter reported earlier, low oil warning light. By now, I knew the car was not leaking oil when in idle and not moving. But it was being burned off or shooting through the tail pipe, I could tell because around that area was getting black. The car is white. So I bring it back again. Same thing as before, then they also tell me it might be normal to be burning that much oil. I am thinking to myself, no way. So I go on my merrily way again. So I decided to drive the car and my daughter my car to borrow. Sure enough about 400 to 600 miles later, I get the low oil warning light and to add a quart of oil. This time, I went back to the dealership and told them they needed to fix this. They took the car in and gave me a loaner vehicle from their lot. It has been 6 weeks and a day since I have heard from them and I did try calling them after the fifth week. Left a message, no call back. I will be going in today because I am getting a service notification on their loaner vehicle for oil and tire rotation change and to top that off their registration is expired as well. Any advice on this would be greatly appreciated. I have been told to call the local AG then BBB then if all else fails, apply the Lemon Law. Let me know what you think. Thanks in advance.

Our engine seized in our Hyundai Tucson as my husband was driving July 2, 2018. No lights, warnings. Having engine fixed under warranty and apparently because of manufacture and shipping our engine has kept being pushed back and we have received a rental from Hyundai, however it is apparently taking 6, SIX, months for us to still be waiting for a new engine to come in? We’ve called Hyundai of America and with no help are still having issues, poor communication, push backs and now our engine apparently won’t be in until “1/10/19”. Unacceptable. What can we do?!

I purchased a brand new 2019 Honda Pilot with the manufacturers warranty from a Honda dealership about 3 weeks ago. Last weekend while I was driving, the car suddenly turned off and I somehow was able to steer the car over to the shoulder so that I wasnt stuck in the middle of the road. I could have easily been struck by the car behind me and it was a very traumatizing experience. The car would not start and Honda had not been able to start the either. They discovered that there wss an issue with the engine head and had to completely pull the engine .This should not have happened with a brand new car, and to be honest I dont even want this car anymore because who can say that this issue cant happen again? I would even take my old car back, but I do not want this car back. Are you able to tell me what my options are?

Bought a new car from BMW – after 5 days and 100miles would not start and they had to tow it (in gear) to the service department. It has been 2 weeks and they have tried to fix it – however the reprogramming of the car isn’t being accepted and there could still be other issues. This is after I ordered a car – and after waiting 3 months it arrived and after 6 weeks (or lies) at the port they finally disclosed it was totaled at the port and couldn’t be released. so I got this POS instead

I have a 2014 Santa Fe that has fallen under the engine recall. Hyundai has had my car for 5 weeks. I called corporate because I am paying for a car I do not have. My original eta was 1 week to 1 month. It then went to 2 months – as per the service manager. Corporate can now not even give a time frame, just to say the engine is back ordered.
I don’t understand what is taking so long. There is more of a back story to this but this is the basics.
They’ve extended all warranties to 120k miles.

Purchased a 2015 Hyundai Sonata SE about 1 year ago. It has approx. 12,000 miles on it. Took into Hyundai to get the recall taken care of (for the knock sensor).
The following day after it was fixed my car stalled and went into limited power mode. Took back and they said it was a wiring harness that it needed. Gave me a rental car from rental company. I’m stuck paying a discounted rate for it while the car is being fixed (which supposedly will get reimbursed). It’s been about 2-3 weeks since and still no wiring harness and my car sits on their lot. What are my options? Thanks!

Last year at the end of May I bought a new 2018 Hyundai Sonata.
Was sent a recall notice for software upgrade they called it.
Brought car to deal on May 2nd (I have put 28000 miles on it) to get oil change and software upgrade. As soon as upgrade was done started sending codes and dealer told me I cannot drive it and has provided me with a rental.
I drive Uber and Lyft and am losing $500 a week because I cannot do ride share with a rental. so far am out at least $1200.00
Today is 4/15, have been dealing now with someone at Hyundai Customer Service, she emailed me today and said still has no information as to when part will be available and said will follow up on Thursday.
My thought is that I bought a brand new car with a problem that Hyundai new about , but chose to still sell the vehicles without advising the buyer of a potential recall or problem.in my opinion the car was in effect a lemon even before I drove it off of the lot.

I bought a 2019 Infiniti. My car passenger door was side swipe in garage at work, not bad but since it was only few months old I wanted it fixed. I called my insurance co and they authorized it to go to the body shop. The part was ordered March 12 and was told it would be in March 19th. I brought it in that day and they took it apart to start work.
Three days later I received a call from the body shop stating the door is on back order and would be released April 14 and expect 7-10 days for delivery.
Today is May 6. I called to complain to Infiniti consumer affairs and was told they do not know when the door will be released, some people have waited 6 months and it could be a year but they hope not.
I am in a rental car at moment. Is there anything I can do or am I just in limbo? I know this does not qualify for the Lemon Law but is there any recourse a person has when you are waiting on something as simple as a door?

Hello from NJ. I purchased a 2017 Jeep Cherokee Trailhawk from Carvana on 11/16/18 with 18k miles on it. Still had balance of factory bumper to bumper warranty. I took the Cherokee to a Jeep Dealer on 4/16/19 for a squeak coming from the rear. They determined that it’s a bad rear axle. They put me in an Enterprise Rental that they are paying for. I’ve been told previously that the part is on backorder, with an ETA of 5/10/19. Today, I was told that the ETA is 7/01/19. That would be over 2 months of my vehicle being at the dealership for warranty work, and 2 months of payments to the auto loan company for a vehicle I cannot drive, although the dealer is paying for a rental.
Could this problem be lemon law related?

Bought a 2016 Santa Fe Sport in Oct 2018. March 23, 2019 took it for the engine knock software update, which seized the engine. I called the dealer on April 17, 2019 and was told it would be 2-6 weeks for the replacement and that I wasn’t the only one without a vehicle. With that attitude and lack of communication from the dealer. I contacted Hyundai and they gave me a date of May 17, 2019. Sent an email to the dealer a day or two before May 17 to see if they had any updates. That’s when I was given a new date of June 3rd. Not only am I paying for a vehicle that I can’t use, I am paying for bluelink and connectcare. Both services that go thru Hyundai. At this point, I will purchase another Hyundai nor will I buy from this particular dealer. Although, I understand its the dealer’s fault that the engine is backorder. If they communicated with their customers, I wouldn’t be so frustrated.

I bought a 2013 Nissan Sentra with 13,000 miles in 2016, dropped my car off at dealer 3 weeks ago with only 36,000 miles on the car because it needs a new transmission. I have the extended warranty however, nobody knows when or if the part will be in. They only approved 5 days of coverage for rental. Now it has been an extreme struggle to get back and forth to work, and I’m still making payments on a car that I don’t know when I’ll get back

Bought a brand new 2018 Hyaundai sonata in September of 2017… had 14 miles on it… took it for regular scheduled maintenance and there where 4 updates needed. Completed and took car home. A week later car seized and bluelink said to take to dealership for repair… dealership said wiring harness and is on back order . Original date I took in was 3/11/19 and I still don’t have my car. The car went in with 22k miles so I believe in just outside of mileage for lemon law but I’m still right at the 18 month mark of owning. Can you help?

Had jeep towed to the dealer on 6/18/2019 due to a severe engine problem and as of today 6/26/2019 they keep making excuses that they will look at it the next day. They have not had time to look at it. Anything i can do?

So I bought 2010 Audi A6 from carvana it came with a 100 day warranty. Had the car looked at my local Audi dealership found that the vehicle has a rear main seal leak. Dropped my vehicle off on 5/22/19 to have fixed under warranty. Its now 7/11/19 and still do not have my vehicle. The dealer did give me a service loaner. But I’m tired of excuses and being without my vehicle now that I am paying for. The lasted time I called was 7/5/19 and was told they just need to put my transmission back in well a week later and no vehicle. The book time to fix this is 10hr according to the estimate they emailed me. Any suggestions please.

We purchased a used 2014 Sante Fe in 2017; I rue the day we ever got that car and used that dealer. Lots of issues, but the worst was when the engine died in March 2019. They took until late July to fix it, and gave us a Veloster as a loaner (!) Then they tell us it’s fixed, charge us over $3,000 (our “25%” of the cost), and within 24 hours a mechanic we trust (who we gave the car to redo the brakes) says the “new” engine is useless. Another tow back to the dealer and who knows when it will be fixed. With all the stories online about engine fires, I don’t even want my 5 year old to ride in it!! Is there any way for use to get the dealer to buy this car back?

Bought a new 2019 Kia Soul on 7/20/19. The car has what was described as a paint defect from manufacturer. The car was dropped off 7/26/19. The car went to a body shop to fix defect. Since then the panel was repainted and came back with a big chip in the panel next to it. They are working with the body shop to fix the new chip. So far I’ve owned the car 30 days and driven it 6 days. August 26th would be 30 days in the shop. Is repainting panels that had defect and the dealer/shop having the car for 30 days a lemon?

Bought a 2013 Chevy Tahoe Hybrid used in 2015. Hybrid specialist diagnosed a problem with the hybrid system on 19 July. The vehicle has been there ever since … the computer module, still under special hybrid warranty, is on “indefinite” backorder. As of today, no loaner available. Anything I can do?

I purchased a 2020 Chevrolet Traverse Premier Redline on Sept 11,2019. On Sept 16th the satellite ( radio & phone) Would not work. Sted ” satellite trying but cannot reconnect) . I left that same day to go out of town and it worked intermittently. On the 23rd went out totally counted dealer shop, set up appt with them at 8:30 Wednesday morning( their ist avail appt) They relented me a vehicle which I paid additional $22 daily insurance ce plan. As of 3:00 they still didn’t look at it. I needed my vehicle back to pick up granddaughters. Spoke to dealer on Friday who suggested I speak to manager of service dept.Tha Mgr instructed me to bring it in on Monday Sept 30th ( which I did) I waited approximately 3 to 4 hrs only for them to do update on system which they said this a temporary fix….Sure enough on Oct 7th thru me dropping back off on Oct 10th the same problem exists….(No satellite connection trying to reconnect also says Loading) Per dealer I was told to contact GM where it escaped to Senior advisor ( which was a waste if my breath) Per GM th part is on backorder and no eta. We are now starting 4th week. I’ve made 2 car payments, paid 30,000 cash down purchased extend warranties, and vehicle is exactly what I was looking. I don’t know how much more stress and all the phone calls to dealership as well to rental agency! Can I not just get this vehicle replaced by GM?
This vehicle is redline, black package, leather seats, third row and loaded with all safety features….exactly what I wanted for my 3 and 1 year old granddaughters. Please advise next step

We have a Buick Envision 2017 with GM Extended Warranty to 80K. Accident (luckily not our fault) on Dec 23, 2019. Car part back ordered, no end in site for part. GM/Buick Division has been contacted. Our Insurance Company (FL is No-Fault) GEICO doesn’t want to total it as repairs are at 60 percent. Who else should we contact?

I live in Calif and was driving home from the beach on July 13 and my air conditioner went out. I have a Kia warranty so I immediately called them. They said they couldn’t get me in until Aug 9th. I live in the Central Valley and it was in triple digits for all of July and most of Aug.
So I tried a reputable shop and they told me to take it to Kia, Clovis Ca because the whole unit, compressor and hose was bad.
Kia then told me Aug 16 but if I brought it in early they might be able to squeeze me in if an appointment didn’t show up. I took it at 7:30am, July 16 and left it for 3 days without any updates. Finally decided a car with no air was better than no car. Picked it up and they found me an appointment for Aug 9th. I was told it was just the hose, and it would probably be fixed by the end of the next week. Aug 9th was a Friday.
They rented me a car through my warranty.
today is Aug 19th and I was told the part still wasn’t in, and if it did come in they probably couldn’t do it because they only have 3 techs. And they blamed it all on Covid.
I found the part online in Va through a Kia parts dealer. Why they can’t find it is beyond me.
I am driving a very tiny rental with 4 people and 3 of these are my daughters with Down Syndrome.
I am so tired of the run around.
Also I worry that it’s not just the hose because the repair guy I took it too is very repeatable and known for his honesty. He told me the whole unit was shot which is why he wouldn’t do the repair since I had a warranty.

I bought a new Hyundai Sonata in November 2020. It is still under warranty (10 year/100k miles) and the turbo went out. When I took it in on August 11, they said the part would be 7-10 days. When it didn’t come in, they informed me it is on back-order and they “have no idea” when it will be in. After pestering them every few weeks, they said the expected date is Nov 15. I’m not sure if they were just lying to get me off their backs or what. I contacted them yesterday to find out if it was still scheduled to come in on the 15th and was told they were unable to confirm that date. I started searching around for the part myself and another dealer said it would be somewhere between March and May before that part is expected in. That will mean my car has been in the shop for 7 to 9 mos. I asked about a loaner and they said they don’t have any. I contacted Hyundai corporate and asked what they were going to do to help me and they said they would pay for a rental car, HOWEVER, they will only pay $35/day, AND I have to pay for it up front and they will only reimburse me once I get my car out of the shop (possibly 6 or more months from now.) The cheapest rental car I have been able to find is more than double what they are offering me as reimbursement. I’m sure it’s not good for my car to just be sitting there for all those months either.

I own a 2015 Jeep Grand Cherokee with 95k miles. My transmission failed two weeks ago and I had the vehicle towed to the Jeep dealership where I purchased it from. I was told they only have one qualified transmission technician and 5 vehicles with similar problems in the queue in front of me. They finally inspected the transmission yesterday and were told it needs to be replaced. I was also told these transmissions are on backorder with no delivery date so I could be waiting a month or longer for repairs. In addition, I was experiencing an engine tapping noise, which was diagnosed as requiring rocker arm/camshaft replacement. This appears to be another well-documented problem with these 2015 Jeep Grand Cherokee vehicles. Together these repairs are in the thousands of dollars, not including the cost of a rental vehicle that I will need for a month or longer. I contacted Jeep USA to see if they would offer any assistance and they flatly refused me.
