How do I know I have a lemon?

A lemon is a vehicle that has a defect that impairs its use, value, or safety. However, there are certain provisions under the Lemon Law that your vehicle must meet to be considered a lemon, which depends on your state’s lemon law statutes.

1) If your vehicle has been out of service for an extended amount of time, it may be a lemon. Depending on your state, there are different amounts of time your vehicle must be out of service, but it ranges anywhere from 15 to 45 calendar or business days. Check your state’s lemon law statutes to see if your vehicle meets these requirements.

2) If it has been in the shop repeatedly for the same issue, it may be a lemon. The number of repair attempts required for your car to be considered a lemon can be anywhere from 1 to 4 for the same issue, depending on the state you live in, the severity of the issue, and whether or not the issue is a serious safety concern. Check your state’s lemon law statutes to see if your vehicle meets these requirements.

Either of these issues must occur within a certain amount of time or miles that you have owned your vehicle, depending on your state. Additionally, your vehicle’s defect must be covered by a manufacturer’s warranty.

If your vehicle does not meet these requirements, don’t lose hope. If it is covered by a manufacturer’s warranty and has been repaired 3 or more times, you still have rights under the Magnuson Moss Warranty Act, and can potentially receive significant compensation to reflect the diminished value of your vehicle.
